📰Legal News Updates from India - Past Week

  1. Allahabad High Court Grants Bail to Juvenile in Serious Criminal Case

The Allahabad High Court has granted bail to a juvenile accused of a serious criminal offense, emphasizing the importance of adhering to Section 12 of the Juvenile Justice Act, 2015 (JJ Act). This decision highlights the court's commitment to upholding juvenile rights and ensuring that their cases are handled according to the law.

Key Takeaways:

- Background: The juvenile, under 16 at the time of the alleged crime, faced a heinous offense charge. Both the Juvenile Justice Board (JJB) and the Special Judge (POCSO) Act initially rejected his bail plea. The juvenile's father filed a criminal revision, claiming false implication and no substantial grounds for detention.

- Court's Ruling: The court emphasized that the offense's gravity is irrelevant for juvenile bail. Section 12 of the JJ Act mandates bail unless release poses a risk of associating with criminals or exposing the juvenile to danger.

- Social Investigation Report: The court stressed the importance of this report, which offers insights into the juvenile's background and circumstances, aiding in evaluating the risk posed by release.
